Duncan McDonnald

will: "I Duncan McDonnald of the town of Carlisle in the County of Cumberland...this 24th day of July 1777...Item, I will that my executors do apprize all my estate in land and goods and then leave them in the hand of my beloved wife Sarah that she may thereby be enabled to maintain my four children Catherine Alexander Margaret & William and give them cloaths & schooling till they come to age. Item I will that when my children come to age they shall have my estate that may then be remaining be equally divided between my wife Sarah and my above said four dhildren...Item I nominate and appoint for executors fo this my last will and testament my trusty friends James Oliver Esqr and Mathew London ...Item I will that if my wife Sarah should marry that then all my personal estate be immediately sold at publick vendue and the money arising from them to be divided between my said wife Sarah and my above said four children equally..."

Theophilus McDonnal

Will: "In the name of God Amen I Theophilous McDonnald of the Township of Milford in the County of Mifflin state of Pennsylvania being in perfect health of body and of sound mind and memory and understanding (blessed be God for the same) but considering the uncertainty of this transitory Life do make and publish this my last will and testament in manner and form following to wit principally and first of all I commend my soul to God who gave it and my body to the earth to be buried in decent and christian like manner at the discretion of my exectutor herein after named and as to such wordly estate whereiswith it hath pleased God to bless me with in this life I give and dispose of the same in the following manner to wit.

First I will that all my lawfull debts and funeral charges be first paid them I give and devise to my loving wife Margaret McDonnald the third part of all my estate both real and personal furcing[?] her natural life if she does not marry but if married the real estate comes to the children but if she does not marry at her decease my will is that all my estate both real and personal be sold and divided in the way and manner following that is to say I leave and devise to my daughter Catharine the sum of thirteen[?] to the children of my daughter Jean I leave and devise the sum of ten dollars and the remainder of my estate my will is that it be equally divided among the rest of the children, that is to say Joseph David Theophilus John Thos my first son and Margaret my youngest daughter except as hereafter excepted that is to say that I leave and devise to my Theophilus and my daughter Margaret the sum of one hundred pounds and my son Thomas the sum of one hundred and fifty pounds extra more that the rest.

And lastly I nominate constitute and appoint my two sons Theophilus and Thomas and my trusty friend James Wilson Esq. of Cumberland County to be executor of this my will revoking all other wills legacies and bequests by me weretofore made and declaring this and no other to be my last will and testament. In witness thereof I move mennent[?] set my hand and seal this tirtyeth day of March AD 1805

Before me William Gibson Deputy for Francis Gibson Esquire register for the Probate of Wills and granting letters of administ County of Cumberland personally appeared Jacob Fritz and William Wilson two fo the subscribing witnesses to the foregoing instrument of writing purporting to be the last will and testament of Theophilus McDonnal deceased and being duly sworn according ot law depose and say that they saw the said testator sign said instrument of writing that he pronounced and declared the same to be his last will and testament that at the time of so doing he was of sound and disposing mind and memory that they wrote their names thereto as witnesses in the presence of the testator at his request and in presence of each other and also in presence of Mary Wilson the other subscribing trustee.
Sworn and subscribed this 30th April AD 1808, Jacob Fritz, William Wilson. for Francis Gibson, Wm C. Gibson.

I William Gibson Deputy for Francis Gibson Esquire register in and for said county of Cumberland do certify that the above probate of the will of Theophilus McDonnal dec'd was taken before me the 30th April 1808 in testemony hereof I have hereunto set my hand and the seal of the Register office at Carlisle County aforesaid.

Probate of Wills & granting letters of Administration in & for the County of Mifflin personally appeared James Wilson and being duly sworn doth say that he wrote the writtin instrument and heard the testator therein named, to wit Theophilus McDonald, acknowledge the hand and seal thereto to be his: that he heard him acknowledge the same instrument of writing as his last will & testmanent that the said testator was the the time of acknowledging the same of sound and disposing mind and memory as he verily believes that he was present when the other witnesses to wit Jacob Fritz Mary Wilson and William wilson signed their names as witnesses to the said instrument of writing and that they signed thier names to the same at the request of the said testator.
Sworn and subscribed the 18th May AD 1808, James wilson
Before me John Norris, Register Mifflin County.

Before me John Norris Register for the Probate of Wills and granting letter of administration in and for the County of Mifflin personally appeared William Wilson one of the subscribing witnesses to the within instrument of writing and being duly sworn doth say that he was personally present and heard the testator therein named to with Theophilus McDonald acknowledge the hand and seal thereto to be his: that he heard the said testator acknowledge the said instrument of writing as his last will adn testament
That the said testator was at the time of acknowledging the same of sound and disposing mind and memory as he verily believes. that he was present when the other witnesses to wit Jacob Fritz and Mary Wilson signed their names as witnesses to the said instrument of writing and that the said testator did request the deponent[?] to sign his name as a witness to the said instrument of writing.

Before me John Norris Register for the Probate of Wils and granting letter of administration in and for the County of Mifflin personally appeared Theophilus McDonald & Thomas McDonald two of the executors named in the last will & testament of Theophilus McDonald late of Milford township dec'd ("The other executor to wit James Wilson by having renounced" - crossed out) and being duly sworn do say that they will and truly administer the goods and chattels rights and credits which were of the said deceased: that they will make or cause to be made an accurate inventory and conscionable appraisment thereof, and whilst the same unto the Register office in Lewistown in Mifflin County and that they will render a just and true amount calculation and reckoning of their said administration in one year from this time or when thereunto law required.
