Will and Estate papers of Robert McDonald, son of Joseph McDonald

 

WILL, probated 1850

I Robert McDonald of the township of Jefferson in the County of Mercer state of Pennsylvania being in delicate health but of sound and disposing mind and memory whilst so desire to settle all my worly[sic] affairs and business do make this as and for my last will and testament in manner and form following, to wit

Item 1

I give and bequeath and devise to my two daughters jointly namely Margaret McDonald and Amanda McDonald ten acres of land the same ten acres of land that I purchased from Rosannah McCutchin [his sister] also they the said Margaret and Amanda McDonald are to have all the household and kitchen furniture and every thing of every kind of property that remains in my house at my deceas

Item 2

I give and bequeath and devise to my son Joseph McDonald the remaining sixty acres of land which I own bounded on the north by lands of William Jennings and on the west by lands owned by A Craigs heirs on the south by lands owned by William McDonald and Robert Wilson and on the last by land claimed by A Breast and the ten acres above devised to Margaret and Amanda McDonald both pieces of land being situated in Jefferson township Mercer County also said Joseph McDonald is to have all the stock cattle sheep horses except one one coalt [ sic] that I will herein after dispose of and to have all my farming tools grain in the ground and grain in the barn or in the grainery Also money notes accounts and judgments all things whatsoever belonging to me charged and chargable with the following named sums of money or legacies to be paid by the said Joseph McDonald as I herein after direct.

Item 3

I give and bequeath and devise to my daughters Isabel McDonald in termarried with John Strong now living in Lawrance County Pennsylvania the sum of Fifty Dollars ($50) to be paid to her the said Isabel one year after my deceas also to my daughter Harriet McDonald intermarried with Henry Smith now living in Lawrance County Penna the sum of Fifty Dollars ($50) to be paid to her the said Harriet two years after my deceas also to pay to my daughter Caroline McDonald intermarried with William Lary of Mercer town the sum of fifty Dollars ($50) to be paid to her the said Caroline in three years after my deceas also to pay to my daughter Rosannah McDonald intermarried with Simon Perrine of Mercer County Penna the sum of fifty Dollars ($50) to be paid to her the said Rosannah four years after my deceas further I give and bequeath to my nephew boy Columbus McLaughlin a boy which I raised in my family the sum of Fifty Dollars ($50) and a black coalt the money to be paid to him five ....[copy of last line folded over] ...

he is to have any time after my deceas further that above five named sums of money or legacies to be paid of my son Joseph McDonald.

Item 4

Hereby nominate and appoint J.W. McCullough my executor of this my last will and testament hereby revoking all former wills by me made. I the testater Robert McDonald have hereunto set my hand and seal this the tenth day of February Anno Domen one thousand eight hundred and seventy.

I Robert McDonald do make and publish the following as a codicil and part of my last will and testament as follows:

Having given and devised ten acres of land by the first item in my original will with all houshold and kitchen furniture to my two daughters Margaret and Amanda McDonald whereas said Margaret McDonald has since died, I hereby direct that said Amanda McDonald shall have said Margaret McDonalds full share of my estate that she the said Margaret would of been entitled to if she had of lived under my will.

Namely one half interest in ten acres of land also all houhold and kitchen furniture and bed and beding the said Margarets interest I give to the said Amanda in adition to what she would get under my will

Received from Joseph McDonald fifty dollars being in full of my legacy under the last will and testament of Robert McDonald late of Jefferson township Mercer Co deceased and I hereby forever release and discharge the said Joseph McDonald from any further liability on account fo the same.

[statement by J.W. Allison and J.W. McCullough that they recognize the handwriting of Robert Wilson and John F. Cornell and were present at their signing of Robert's last will and testament. That Robert Willson is now dec'd and John Cornell no longer lives in Mercer County. signed 8 July 1881]
