To the Honorable S.S. Mehard Judge of the Orphans court of Mercer County
The auditors appointed by the Court to report distribution of the balance in the hands of the Administrators of Margaret McDonald deceased to and among those entitled thereto, agreeably to the certificate hereto annexed, respectfully reports: That after having been duly sworn to perform the duties of his appointment with fidelity and having given due legal notice of the time and place of meeting by advertisement in the Mercer Republican and Mercer Dispatch, weekly newspapers of general circulation published in this county, agreeably to the certificates of publication hereto attached, and met the parties at his office in the borough of Mercer on Saturday the 1st day of March 1885 at 10 o'clock a.m. and by adjournment from time to time thereafter.
That Johnson Pearson Esq. appeared as counsel for the administrator, H.H. Zeigler Esq for the heirs of Joseph McDonald dec'd, R.A. Stewart Esq and W.H. Cochran Exq, for Isabella Strong Amanda McDonald Caroline Lary and Columbus McLaughlin. W.A. McCormick Esq for William Zahinser an attaching creditor for William McDonald, and Alex Eastlick for his wife Nancy Eastlick an attaching creditor of same.
The said Margaret McDonald died on the 4th day of December 1880 intestate, she had never been married and left as her heirs her brothers and sisters, and representatives of deceased brothers and sisters, as follows: Sarah Espy and Nancy Eastlick sisters and William McDonald a brother are still living and Mary Taggart Jane Eastlick, Rosanna McCutcheon deceased sisters who had died previous to the death of Margaret McDonald but who left issue as herein after stated, and Robert McDonald and Joseph McDonald deceased brothers who had also both died previous to Margaret's death but who had left issue. The fund for distribution among the heirs then must be divided into eight shares giving to each brother or sister or the legal representatives of deceased brothers and sisters one share.
Mary Taggart - a deceased sister left as her heirs four sons James Taggart, John W. Taggart, George Taggart and Sulvanus Taggart and the representatives of a deceased daughter Mary Thorp(?) who had died prior to the death of Margaret McDonald leaving issue, but your auditor was unable to obtain any evidence of the number names or residences of her issue. The share that Mary Taggart would have received if living is therefore divided into five equal shares one to each of her said sons and the one that her said deceased daughter would have been entitled to have received had she now been living is not distributed.
Robert McDonald a deceased brother left as his heirs five daughters and his son as follows Isabella Strong Harriet Smith Rosen Perrine Caroline Lary Amanda McDonald and Joseph McDonald and the representatives of a deceased daughter Elizabeth McLauphlin who had died prior to the death of Margaret McDonald leaving issue one son Columbus McLauphlin. The share that Robert McDonald would have received if living is therefore divided into seven parts giving to each one of Roberts children or their representatives one seventh.
Joseph McDonald a deceased brother left as his heirs five children as follows William P. McDonald, Ellen J. McDonald, Mary A. Riddle, Sarah E. McDonald and J. Newton McDonald who are each entitled to one fifth of the share their father Joseph McDonald if living would have gotten. William P. McDonald has assigned his share to his sister Ellen J. McDonald, assignment hereunto attached.
Jane Eastlick a deceased sister left as her heirs three sons and five daughters and the representatives of a deceased daughter as follows, A.S. Eastlick Alfred Eastlick, B.J. Eastlick, Rosanna Eape(?), Carrie M. Bullock, and the representatives of Sarah J. Capman who died before Margaret McDonald but left surviving her issue as follows: Sanderson E. Capman, Alfred J. Capman, Alice Capman, now intermarried with John Summers, Carrie Capman, and J.M. W. Capman the last two being minors and residing in LaGrange Co. Indiana. The share that Jane Eastlick would have received then if living is therefore divided into six parts, one sixth to each of her children now living and on sixth that the said Sarah J. Capman the deceased daughter is equally divided among her five children.
Rosen McCutcheon a deceased sister left as her sole heir a son James P. McCutcheon who is therefore distributed the share his mother if living would have gotten.
A note given by Margaret McDonald to Westminster Collegiate Institute, located at New Wilmington Pa, and hereto attached was presented to auditor and allowed , on which the balance due is six & 60/100 dollars.
The records of the Court of Common pleas of Mercer County at Nos. 86 & 87 January Term 1881 in the case of Zahniser & Logan use of William Zahniser vs William McDonald show that executive attachment was issued and duly served and Andrew Mills the first administrator of said estate and also as the defendant, your auditor therefore appropriates out of the share of the said William McDonald the sum eighty-six & 98/100 being the debt interest and costs in said cases. The records of said court also show that afterward the interest of said William McDonald was also attached at the suit of Nancy Eastlick on judgment filed at No 243 October Term 1880 and Ex, Allotment to No 92 January Term 1881, and duly served on said administrator and defendant, your auditor therefore appropriates the balance of the share of said William McDonald to said judgment to be applied on same.
