This 31st day of Oct 1835 personally oppeard before me a justice of the Peace in -- Mercer County Wm McDonald & Wm Swager who after being duly sworn according to law did depose and say that the within appraisement is true & made with impartiality.

Petition of Philip Waggoner for Proof of paral[?] contract

 

To the Honorable the Judges of the --- [faded] in and for the county of Mercer

The petition of Phillip Waggoner of said County - Respectfully represents that sometime previous to the year AD 1834 Othel McDonnald late of said County, deceased, in his lifetime was[?] duly seized & possessed of two hundred acres of land situate in Delaware Township, Mercer County, No. 679 in the 4th Dist. of Donation lands - and living so seized entered into a paral[?] contract with William Swager for the sale of fifty acres to let[?] run off the North west corner of said tract, to be bounded on the North by land of John Cain - on the west & south by balance of said large tract & on the west by lands of John & Lewis Blashford. At the price of one dollar per acre therefor - that the said Swager took possession in pursuance of said contract built a house & cleared seven of eight acres of said land & made other valuable improvements threon - and afterwords, to wit, in the year 1836, while in possession there of , entered into a written contract with your petitioner for the sale of the same ^ of two hundred dollars ($200.00) ^ for the consideration having paid the whole amount of the aforesaid fifty dollars to the said Othel McDonald in his lifetime and his administratrix after his death - and your petitioner in pursuance of said last mentioned contract took possession & made valuable improvements & has continued to reside on the land guestcide[?] & has paid the whole of said purchase money to said Swager - that the said Othel McDoanld died without making a deed for the same or making provision therefor, leaving a widow, who is since deceased - an two children who are minors to wit Sarah under the guardianship of James T. Black & Othel under the guardianship of Benjm. F. Baskin.

Your petioner would therefore pray your Honors to secure proof of paid contracts & draw a specific execution[?] of said the same ther[?] will saer[?] pray so[?].
