The Petition of Theophilus McDonald the father of Rebekah McDonald, Polly McDonald, Theophlus McDonald, and John McDonald, minors under the age of fourteen years - was presented stating that the aforesaid minors are entitled to a small dividend of the estate of John Walker Dec'd in right of their mother late Gracy Walker dec'd and praying the court to appoint a suitable person as guardian of said minors for the purpose of taking care of the said estate. Whereupon the court appointed James Borden as guardian for said minors.

KNOW ALL MEN, by these presents, that I, William W Pearson of Mercer
county, are held and firmly bound, unto the commonwealth of Pennsylvania,
in the sum of two hundred Dollars lawful money of the United States, to
which payment well and truly to be made, we bind ourselves, and each of
us by himself, for and in the whole, our heirs, executors and administrators,
and each of us firmly by these presents. Sealed with our Seals, dated this
fourth day of November A.D. 1841
The condition fo this obligation is such, that if the above bounden William
W Pearson guardian of Lemuel Amelia Arabela William Levingston Phebe and
John McDonald minor children of Wm HS McDonald late of Mercer coutny, deceased,
shall at least once in every three years, and a t any other time when thereunto
required by the Orphans' Court for the county of Mercer render a just and
true account of the management of the property and estate of said minors
under his care, and shall also deliver up the said property, agreeably to
the order and decreel of said court, or the directions of law, and shall
in all repsects, faithfully discharge the duties of Guardian of said children
then the above obligation shall be void, otherwise it shall be and remain
in full force an dvirtue. Witnesses at signing, Wm W. Pearson

State of Pennsylvania, Mercer County --
An Inquisition inderted[?] and taken at the Township of Jefferson in the
County of Mercer aforesaid this 29th day of July AD 1853 before Jonathan
McMillen Esquire high Sheriff of said County, by the oaths and affirmations
of the jurors whose names & seals are herunto annexed, good & lawful
men of my bailwick who say upon their oaths and affirmations aforesaid that
having been taken by the said Jonathan McMillen high Sheriff as aforesaid
in his proper person to the premises, described in the writ to this Inquisition
annexed and the parties in the said writ named having been severally named,
and as many as chose being present [?] the property or premises
The undersigned jury having viewed the property herein described, do hereby
agree that the Property or premises aforesaid cannot be parted or divided
without prejudice to or spoiling the whole and therefore, that they have
valued & appraised the same at the sum of two thousand four hundred
dollars and forty nine cents being sixteen dollars thirty three and one
third cts per acre.
In testimony whereof as well I the said Sheriff as the jurors aforesaid
to this Inquisition have set our hands and seals the day & year above

Orphans Court of Mercer County, No 5, May T. 1853
In the matter of the partition of Real Estate of Othol McDonald deceased
Inquisition held and property appraised at two thousand four hundred 49/100
dollars. Inquisition confirmed by the Court & Rule on the heirs and
legal representatives to appear dc [oc?].
And now Nov 14, 1853, Othel McDonald comes into court and respectfully prepresents;
That he is the eldest son of above named descedent, that he and his sister
Sarah McDonald are the only children and heirs at law of said descedent;
He therefor prays the court to permit him to take the premises on which
above stated Inquest was held, and that the court will decree[?] the same
to him[?] according to law.

And now, Nov. 14, 1853 Prayer of the petitioner granted, And the Court award
the premises on which Inquest was held to Othel McDonald and decree the
same to vest the title in him his heirs & assigns[?] and direct him
to enter into a recognisance with one [smeared} in the sum of twenty five
hundred dollars conditioned for the payment to the other heirsof the said
deceased their share or [?] in one year with interest from this date.
